Public Offer

1. General Provisions

1.1. Online Store— the website KIKAMADE.COM, intended for selling goods online.

1.2. Seller— Individual Entrepreneur Statkevich E.V., Kyiv, Ukraine.

1.3. Buyer— an individual or legal entity that places an order on the website.

2. Subject of the Agreement

2.1.The Seller undertakes to manufacture and deliver the goods, and the Buyer undertakes to pay for and accept them.

2.2.The agreement is considered concluded from the moment the order is placed on the website and confirmed by the Seller.

3. Order Placement

3.1.The Buyer independently places an order through the website or through contact channels.

3.2.The Seller has the right to refuse to fulfill the order in case of incorrect or suspicious data.

3.3.To place an order, the Buyer provides:

  • ім'я та прізвище;
  • номер телефону;
  • delivery address (if necessary)

3.4.The Buyer is responsible for the accuracy of the provided data.

3.5.By placing an order, the Buyer agrees to the terms of the offer and consents to the processing of personal data for the fulfillment of the order.

4. Price and Delivery

4.1.Prices are indicated on the KIKAMADE.COM website in hryvnias.

4.2. Продавець може змінювати ціни без попередження, але це не впливає на вже оплачені замовлення.

4.3. Вартість доставки оплачується Покупцем згідно з тарифами перевізника.

4.4. Орієнтовна вартість доставки може бути уточнена при оформленні замовлення.

4.5. Право власності переходить до Покупця з моменту передачі товару службі доставки або отримання замовлення.

5. Права та обов’язки сторін

5.1. Продавець зобов’язаний:

  • виконати замовлення відповідно до умов
  • забезпечити конфіденційність даних клієнта

5.2. Продавець має право:

  • змінювати умови сайту та ціни
  • відмовити у замовленні при порушеннях

5.3. Покупець зобов’язаний:

  • надати правильні дані
  • ознайомитися з умовами перед покупкою

6. Повернення товару

6.1. Покупець має право повернути товар належної якості протягом 14 днів, якщо він не був у використанні та збережено товарний вигляд.

6.2. Товари з індивідуальним друком виготовляються під замовлення і не підлягають поверненню, оскільки мають індивідуальні властивості.

6.3. Повернення коштів здійснюється банківським переказом.

6.4. Витрати на повернення товару несе Покупець.

6.5. У разі дефекту товару застосовується законодавство України про захист прав споживачів.

7. Відповідальність

7.1.The seller is not responsible for the improper use of the product.

7.2.The seller is not liable for errors in the order if they occurred due to incorrect data provided by the buyer.

7.3.In the event of force majeure, the parties are released from liability.

7.4.The buyer is responsible for the use of images provided for printing (copyright).

8. Personal Data and Privacy

8.1.By placing an order, the buyer agrees to the processing of personal data.

8.2.The data is used solely for:

  • processing and delivering orders
  • communicating with the client
  • improving the service

8.3.Data may be transferred to third parties only for the fulfillment of the order (delivery, payment).

8.4.The seller does not sell personal data to third parties.

9. Other Terms

9.1.The contract is governed by the laws of Ukraine.

9.2.All disputes are resolved through negotiations or in court.

9.3.The seller has the right to change the terms of the offer unilaterally by publishing updates on the website.
